Abaco’s representatives, Petar Djurovic and Maja Radunovic-Culafic, participated in the 5th Kotor International Maritime Conference (KIMC), organized by the Faculty of Maritime Studies Kotor, held in Kotor from 26–28 November 2025.
They took part in Session A.2 | Maritime Law, chaired by Dr Senka Sekularac-Ivosevic, held on Thursday, 27 November 2025, at Hotel Cattaro. The session examined contemporary challenges in maritime regulation and provided an excellent platform for our colleagues to present their long-standing research on berth agreements in Montenegro.
Their presentation, “Berth Agreement in Montenegro – De lege lata & de lege ferenda” outlined key legal gaps in the current framework, highlighted inconsistencies in the practice of local marinas, and emphasized the urgent need to formally regulate berth agreements within the Montenegrin legal system.
Based on experience Abaco has had in advising marinas in Montenegro, including preparation of their General Terms and Conditions, Maja and Petar provided a comprehensive analysis of the legal nature of berth agreements and explained the implications of the existing regulatory gap.
In their presentation, Maja and Petar also gave reference to Abaco’s participation in the public debate on the Draft Law on Ports, which resulted in acceptance of their proposal to include regulation of berth agreements in the said Draft Law. This development is expected to increase the responsibility of port operators and users, reduce harmful incidents and improve safety in nautical ports, strengthen protection for vessel owners through a clear legal regime, and enhance Montenegro’s attractiveness as a destination offering a reliable and predictable maritime environment.
This year’s KIMC once again proved to be a highly valuable platform for exchanging knowledge and fostering regional cooperation in the maritime sector. The conference concluded as a great success, reinforcing its role as a key forum for advancing roles of maritime professionals in Montenegro and beyond.
