Abaco Ltd has provided legal assistance in the preparation of the General Terms and Conditions of Business and the Rules on Maintaining Order for Shipyard Port Bonici in Tivat, establishing a comprehensive regulatory framework for port operations and supporting the further development of Navar Incorporated.
The project posed a major professional challenge, requiring the creation of a regulatory framework for a shipyard port that combined Abaco’s expertise in arbitration and dispute resolution for shipbuilding clients, including the established legal practice of the former Adriatic Shipyard Bijela, and prior experience in structuring marina operations, ultimately producing instruments tailored to shipbuilding, repair, and modification activities.
The adoption of these instruments represents a significant step toward strengthening contractual certainty and operational transparency. The General Terms and Conditions of Business define clear and enforceable rules governing agreements related to shipbuilding, repair, modification, accommodation, and maintenance.
By standardizing contractual relations between the Shipyard Port Bonici and its service users, these provisions reduce legal risk, enhance client confidence, and position Navar as a reliable partner in complex maritime projects. Through precise codification of rights and obligations, the framework supports long-term projects, protects the interests of all stakeholders, and ensures that operations are conducted with legal certainty and professional discipline.
One of key features of the General Terms and Conditions is their alignment with the Law on Maritime and Inland Navigation (MINA 1998). In this way, national legislation is embedded into everyday operational practice, supporting both regulatory compliance and high service standards.
In parallel, the Rules on Maintaining Order introduce a structured regime for daily port activities. They regulate vessel entry and departure, mooring procedures, safety standards, environmental protection measures, and prohibited conduct. In this way, the Rules ensure that port activities and customer behavior are carried out efficiently and in full compliance with Montenegro’s statutory framework.
This comprehensive project was delivered through close cooperation between Navar and Abaco, combining legal expertise with operational insight. It was especially rewarding to once again confirm that a long-standing professional and personal relationship built on trust and mutual respect can be a powerful driver of productivity and successful collaboration.
The resulting framework transforms regulatory requirements into practical governance tools that enhance efficiency, reduce the risk of disputes, and contribute to the protection of the marine environment.
